The term 'podcast' has been declared Word of the Year by the New Oxford American Dictionary.

The official term, to be added to the online version of the dictionary during the next update early next year, is defined as "a digital recording of a radio broadcast or similar program, made available on the Internet for downloading to a personal audio player".

The word is derived from a combination of "broadcasting" and "iPod".

According to a recent Pew Internet and American Life Project survey "Podcasts" are catching on with people who own iPods or other digital-music players. Twenty-nine percent of U.S. adults who own MP3 players like Apple Computer Inc.'s iPod say they have downloaded podcast programs from the Internet. In Pew's poll, 11 percent of respondents said they owned an MP3 player, putting the total U.S. ownership at 22 million. Of those with MP3 players, 29 percent reported listening to a podcast. Pew said the survey has a 7.5 percent margin of error.

A Podcast consists of high resolution MP3 or other audio files wrapped in a RSS feed, RSS or really simple scripting is widely used on the web as a means to create news feeds or product updates that can be read bybrowsers and other websites. Podcasts have grown in prominence along with Weblogs, the online diaries that serve as alternative news sources reports LordPercy.

The term was coined by journalist Ben Hammersley and although originally derived from combining "broadcasting" and "iPod", this definition has become something of a misnomer as podcasts can be listened to on any digital music player reports BBC.

Some have criticised the term for giving too much credit to Apple, which had little to do with the development of the technology and some have tried to suggest alternative terms such as blogcasting or audioblogging.

Consumers upset about their iPod nano screen becoming easily scratched have filed a class-action lawsuit in the U.S. District Court in the Northern District of California in San Jose against Apple Computer, demanding their money back plus a share of the company's profits. Shortly after the iPod Nano was released, Apple boards were filled with compliants.

The lawsuit alleges nano owner Jason Tomczak rubbed a paper towel on the face of his nano and "that alone left significant scratches." I am sure it was probably really dry, hard paper

According to American Technology Research analyst Shaw Wu, black models of the iPod nano are outselling white models. "Our checks continue to indicate good iPod nano sales, albeit not great," Wu said in a research noted obtained by iLounge. "Black nanos are selling well, while white nanos continue to lag. We are hearing that Apple grossly underestimated demand for the $249 black 4GB iPod nano and is realigning its supply chain to meet this demand dynamic."

"In the meantime, we believe some customers looking for a black 4GB iPod nano end up buying a black 2GB nano or white 4 GB nano as a compromise," he said. "We continue to believe that iPod nano may need a storage upgrade and/or price cut to spur sales beyond black 4GB iPod nanos."

There is a debate on whether Apple's iPod Nano infringes on Creative's Zen Nano Plus. According to Apple haters (I kid) - the Creative Zen Nano Plus launched before the iPod Nano, it's a flash-based player - the iPod Nano is a flash-based player, the Creative Zen Nano Plus is available in black or white - the iPod Nano is available in black or white - so the iPod Nano totally copied from Creative the Zen Nano Plus

According to the register,

a Creative spokesman acknowledged Apple's use of the Nano name long after the Zen's arrival, and confirmed that the company's legal department was also aware of the matter. However, he would not comment on any action Creative may or may not take.

Louis D. Brandeis School of Law professor Lars Smith told The Mac Observer that, while Apple's use of the word "nano" after Creative had already established it in the marketplace may seem like infringement, such a claim requires a multi-factored test by a court, which includes comparing the marks' look ("Zen" is much more prominent on Creative's page than "Nano," he pointed out), typical consumer knowledge, the junior user's intent (which would be Apple's intent, in this case) and more.
